With regard to data transfer and payment collection for taxi transport services, OMW Croatia, as a data processor, uses the services of certified legal entities that are required to comply with standards and measures for the protection of users’ personal data.

Right to delete data

you have objected to the processing of personal data,
you believe that the processing of data is otherwise unlawful,

you may request that we delete your personal data, unless a specific regulation requires the retention of certain personal data.

Right to Lodge a Complaint with a Supervisory Authority

If you believe that we are processing your personal data unlawfully, you have the right to lodge a complaint with the supervisory authority for personal data protection. In the Republic of Croatia, the competent authority is the Croatian Personal Data Protection Agency (www.azop.hr). If your habitual residence or workplace is in another EU Member State, or if you believe that your rights have been violated in another EU Member State, you may in any case also contact the supervisory authority of that state.

Changes to the Terms of Use and Privacy Policy

We reserve the right to amend the Terms of Use and Privacy Policy at any time, so please review them regularly. Changes and clarifications will take effect immediately upon publication on the website. If we make significant changes, we will notify you here that the policy has been updated, so that you are aware of what information we collect and how we use it.

Terms of Use

These Terms of Use ("Terms") manage your access to or use of, as an individual, the applications, websites, content, products, and services ("Services") provided by OMW Croatia.

You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes (e.g., you may not transport illegal or hazardous materials). You agree not to cause disruptions, inconvenience, or property damage to OMW Croatia employees, third-party service providers, or any other party while using the Services. You acknowledge that your access to or use of the Services may be denied if you violate these Terms.

OMW Croatia does not guarantee that the Services, or any part of them, will function on any hardware or device. Additionally, the Services are subject to malfunctions and delays inherent to the use of the internet and electronic communications.

By using the omw-croatia.hr website, you agree that we may contact you to provide information about your account, resolve account-related issues, address disputes, collect fees or debts, send updates about our company, or otherwise contact you via email, phone calls, or SMS as necessary.

OMW Croatia will not send you marketing materials or spam.

Payment, Service Pricing, and Trip Cancellation

Fees paid are final and non-refundable unless determined otherwise by OMW Croatia, in accordance with applicable laws.

Card details will only be used to pay for taxi services ordered and utilized.

The service price is agreed upon before the ride, based on current demand or a certified price list, measured using a certified taximeter. The price list includes the start fee, per-kilometer charge, and hourly waiting rate, valid 24/7. By entering the vehicle, the user consents to and accepts the fee, which will be calculated upon arrival at the destination or upon the requested completion of the ride at the nearest legal stopping point.

The user may cancel a booked ride at any time before the ride begins without incurring a fee. The user may also cancel during the ride, provided the vehicle can legally stop. Refunds or exchanges for completed rides are not permitted, regardless of the level of completion, unless otherwise determined by OMW Croatia in accordance with applicable laws.

Users may change the payment method (cash, card) before the ride starts. Once the ride has begun, the payment method cannot be changed until the ride concludes. If the card payment authorization is declined after the ride ends, the user agrees to cover the cost of the ride in cash or by other means, with deferred card charges permitted within 60 days. By accepting the Terms, the user consents to subsequent charges.

OMW Croatia reserves the right to charge and retain fees solely for services used in accordance with business terms and applicable regulations.

Refund Rights

The user has the right to a full refund if it is proven that the service was not provided in accordance with business terms or applicable regulations, provided the taxi service provider is solely responsible for improper execution.

Repair or Cleaning Fees

You are responsible for repair or necessary cleaning costs for vehicles owned by OMW Croatia employees or property damage caused by your use of the Services, exceeding normal wear and tear.

Liability

You agree to indemnify and hold harmless the service provider from any claims, demands, losses, liabilities, and costs arising from or related to your use of the Services, your violation of the Terms, or your infringement of any third-party rights.

Miscellaneous Provisions

If any provision of these Terms is deemed unlawful, invalid, or unenforceable in whole or in part under any law, that provision or part will be considered not part of these Terms. However, this will not affect the legality, validity, and enforceability of the other provisions. The parties are responsible for replacing unlawful, invalid, or unenforceable provisions with legal, valid, and enforceable ones that have a similar effect to the original provision to the greatest extent possible, consistent with the content and purpose of these Terms.

These Terms constitute the entire agreement between the parties concerning their subject matter and supersede all previous or existing agreements or arrangements related to that subject.
